MADRID PROTOCOL

As from October 2, 2019, Brazil has entered into the Madrid Protocol. International Trademark Applications can now designate our country and Santa Cruz is pleased to inform that the Brazilian Patent and Trademark Office (BPTO) recently started publishing these applications.
It is important to notice that the International Bureau will not be notified about some local proceedings, such as oppositions, similar or identical trademarks filed by others, etc which will be published exclusively in the national Gazette.
As no communication will be sent to the holder of the international registration about the above proceedings, it is recommended that the holder appoints a local representative to monitor the publications directly in the national Gazette.
Santa Cruz keeps an exclusive department to monitor Brazilian trademark designations, in order to acknowledge any publication, identify similar or identical trademarks filed by others so the clients can take the necessary actions in a timely manner.

TRADEMARKS

Only the registration granted by the Federal Government can protect trademarks effectively in Brazil. The registration of your trademarks in other countries does not protect it in our country. The registration of trademarks in Brazil is regulated by the Industrial Property Law (Law No. 9.279, of May 14, 1996), which regulates rights and obligations relating to Industrial Property.
In order to obtain a trademark registration in Brazil, it is necessary to file an application at INPI, which will examine it based on the provisions of the Industrial Property Law.
PATENTS

Patent is a way of incentive to the continuous technological renovation and of stimulus to the company’s investment. More than protect the invention’s owner, it contributes to the economic and social development of the country. The invention needs to be officially protected and it can only be done by the Federal Government. Only patents give inventors sole right to determine who can and who cannot use their inventions commercially.
INDUSTRIAL DESIGNS

Industrial Design Registration (“DI”) is any ornamental plastic form of an object or any ornamental arrangement of lines and colors which may be applied to a product, resulting in a new and original visual effect in its external configuration, which can be used as a model for industrial manufacture.
